Monster Energy Drink-Maker Doesn’t Believe in ‘Vermonster’ Beer

Law.com:  “Forget David and Goliath.  This fight’s between Matt and Monster.  The maker of Monster energy drinks has taken aim at a Vermont brewery that sells a beer called “The Vermonster,” ordering it to stop selling, advertising and promoting the craft brew because it could confuse consumers.  The energy drink-maker, Hansen Beverage Co., wants tiny Rock Art Brewery to stop using the name “Vermonster” on the barley brew and to compensate it for its attorneys’ fees.”

New FTC Rules Aim to Kill the Buzz on Blogs

Citizen Media Law Project:  “On October 5, the Federal Trade Commission issued new guidelines (large pdf) on advertising involving endorsements and testimonials. The guidelines, which are due to go into effect on December 1, have caused a stir among bloggers, journalists, and new media types because they appear to place significant requirements and restrictions on blogs and social media. Most notably, they suggest that bloggers or other consumers who “endorse” a product or service online may be liable for civil penalties if they make false or unsubstantiated claims about a product or fail to disclose “material connections” between themselves and an advertiser.”

NBC Hit With Font Infringement Suit

Wall St. Journal:  “We’re going on a limb this afternoon to say the biggest battle over fonts ─ ever ─has broken out in New York federal court.  NBC has been sued by the Font Bureau Inc., a typographic design firm, which alleges that the network infringed the firm’s fonts in marketing material used to promote such NBC shows as Saturday Night Live, The Jay Leno Show, and Late Night with Jimmy Fallon.”

Doctor Charged With Fraud For Prescribing Herbs to Cancer Patients

Wall St. Journal:  “Christine Daniel, a California physician offered something that every terminally ill patient yearns to hear – the promise of a possible cure. But now the Mission Hills, Calif. doctor stands accused of using her influence as an ordained Pentecostal minister and inducing dozens of desperately ill people nationwide to buy her expensive brown liquid infused with herbs. Daniel was arrested Thursday at her home in Northridge and charged with breaking several federal laws, including committing wire fraud. . . . Daniel was able to induce at least 55 people to drink her mixtures, spending more than $1 million . . . .”
