Illinois Top Court Strikes Down Medical Malpractice Caps

Chicago Tribune:  “The Illinois Supreme Court struck down the state’s medical malpractice law today, saying it violates separation of powers by allowing lawmakers to interfere with a judge’s ability to reduce verdicts.  The much-anticipated ruling, which challenged the constitutionality of damage caps for doctors and hospitals, is being watched closely by the health care industry and employers that see caps on damages as a way to tame rising health care costs.”

John Edwards’ Mistress Seeks Return of Alleged Sex Tape

CNN:  “The legal battle over a sex tape allegedly showing former Sen. John Edwards and former mistress Rielle Hunter is expected to further unfold in a North Carolina court Friday.  Former Edwards aide Andrew Young and his wife, Cheri, are expected to appear in court to contest a temporary restraining order forbidding them from disseminating the videotape and seeking its return to Hunter.”

Family Can Sue Highway Patrol Over Photos

Courthouse News Service:  “Two California Highway Patrol officers who emailed gruesome photos of a decapitated 18-year-old accident victim to their friends on Halloween, ‘for pure shock value,’ must answer to claims brought by the victim’s family after the images ‘were strewn about the Internet and spit back at family members, accompanied by hateful messages,’ a California appeals court ruled.  Justice Richard Aronson revived the family’s privacy claims and chided the officers for their allegedly ‘morally deficient’ behavior.”

Class Action Lawsuit Alleges Chicago’s Funding of Chicago Transit Authority is Racially Biased

Chicago Breaking News Center:  “CTA riders have long grumbled about getting a raw deal with high fares and skimpy service, and a federal lawsuit filed Wednesday argues that the complaint is not just real but fueled by policies that favor white commuters over blacks and Hispanics.  At stake is more than $1 billion in tax dollars split each year among the CTA and the suburban-based commuter railroad and bus lines, Metra and Pace.  Most of the aid goes to the CTA, which serves a far larger share of minority riders than Metra and Pace. But the suit contends that cut is still too low and seeks to remedy things by shifting resources away from the suburban transit agencies.  It blames chronic racism for shortchanging the CTA, disproportionately harming black and Hispanic riders.”  See a copy of the complaint.

Allergan Corporation Sued Over Alleged Botox Death

Lead Counsel Corner:  “Ms. Dee Spears of Texas has filed a wrongful death lawsuit against Allergan corporation, the maker of the cosmetic drug Botox, over her seven year old daughter’s death.  ABC News reports that the girl was using Botox in order to treat muscle spasms that she suffered from because of cerebral palsy. Ms Spears claims that her daughter’s death was a Botox death.”
