Photo-enforcement Critic’s Cases Raise Issues with System

Arizona Republic:  “For photo-enforcement critics, Dave Vontesmar became something of a hero after he was accused of speeding down Valley freeways with a monkey mask strapped to his head.   But as Vontesmar’s many alleged violations have entered the court system, his cases have demonstrated some issues related to the volume of violations that few predicted when the statewide photo-enforcement program hit Arizona: overwhelmed courts, violations that aren’t served or are dismissed and hearings that are set many months after the citation arrives in the mail.”

Four Lawyers Nominated for Arizona Court of Appeals

The Commission on Appellate Court Appointments has recommended four candidates to Governor Jan Brewer for an opening on Division Two of the Arizona Court of Appeals created by the appointment of Chief Judge John Pelander to the Arizona Supreme Court.

The nominees are Christina M. Cabanillas, Democrat, Appellate Chief of the United States Attorney’s Office; Gary J. Cohen, Democrat, a partner with the law firm of Mesch, Clark & Rothschild, P.C.; Virginia C. Kelly, Republican, a judge in the Pima County Superior Court; and, Michael O. Miller, Republican, a judge in the Pima County Superior Court.

Governor Brewer will appoint the new judge.

Goldwater Institute Appeals Court Decision on Renewable Energy

Phoenix Business Journal:  “The Goldwater Institute is appealing the Maricopa County Superior Court decision on its lawsuit looking to have Arizona’s renewable energy standards thrown out.  The institute filed suit against the Arizona Corporation Commission last year, questioning the ACC’s authority in setting the standard requiring utilities such as Arizona Public Service Co. to meet certain levels of renewable energy in their portfolio and to levy a tariff through customer bills to help pay for it.
